Terms of Use
These Terms of Use constitute an electronic contract that establishes the legally binding terms you must accept to use JRI-Poland’s website and the online database that may be searched on that website. To use JRI-Poland’s online database, you must first agree to these Terms of Use.
You may use JRI-Poland’s online database for: (1) your personal, non-commercial use in family history or family tree projects; and (2) the preparation of books or articles. Information derived from JRI-Poland’s online database for family history or family tree projects may be included in trees posted online.
If you include information from JRI-Poland’s online database in a book, article, or a personal website, you shall provide credit to JRI-Poland by stating substantially as follows: “Certain genealogical information set forth herein is based upon research performed on the website of Jewish Records Indexing-Poland, Inc. (www.jri-poland.org).”
You shall not, without the prior written consent of JRI-Poland, use JRI-Poland’s online database for any purpose not expressly authorized in these Terms of Service.
If you wish to use JRI-Poland’s database for commercial purposes, such as for professional genealogical research including for documentaries, you may send a written request to JRI-Poland at [email protected]. JRI-Poland will then review the request and will respond in due course.
You acknowledge and agree that you shall not, without the prior written consent of JRI-Poland, publish or disclose any spreadsheets, indices, or extracts that have been prepared by or for JRI-Poland, or that are available through JRI-Poland’s website.
You acknowledge that use, publication, or disclosure of information in a manner not authorized by these Terms of Use may compromise of the agreement between JRI-Poland and the General Director of State Archives through which JRI-Poland has obtained access to the materials maintained by the Polish State Archives, and that such use, publication, or disclosure might endanger JRI-Poland’s relationship with the Archives.
JRI-Poland has the right to deny, revoke, limit, suspend, or terminate your access to JRI-Poland’s online database if you violate or act inconsistently with the spirit of the Terms of Use. You acknowledge and agree that your breach of these Terms of Use may cause irreparable harm to JRI-Poland, the extent of which would be difficult to ascertain. Accordingly, you agree that, in addition to any other remedies to which JRI-Poland may be legally entitled, JRI-Poland shall have the right to seek preliminary and permanent injunctive relief in the event of such breach.
These Terms of Use shall be governed by and construed under the laws of the State of Maryland and the United States, without regard to principles of conflicts of laws. The United States District Court for the District of Maryland and the Circuit Court of Montgomery County, Maryland shall be the exclusive venues for all lawsuits arising under or relating to these Terms of Use and JRI-Poland’s Privacy Policy. The parties waive all defenses based upon lack of personal jurisdiction or venue as to any lawsuit that arises under or is related to this Agreement.
In consideration for the use of JRI-Poland’s website, you represent that: (1) you have read and agree to these Terms of Use and JRI-Poland’s Privacy Policy; and (2) you are legally able to register (if required) to use such website. If you submit personal information to JRI-Poland’s website, you agree to provide true, accurate, current, and complete information about yourself (including during the registration process) and to maintain and keep current and accurate this information about yourself, should it ever change. If you provide false, inaccurate, inappropriate, or libelous information, JRI-Poland may suspend or terminate your account and use of JRI-Poland’s website.
During the registration process, you will be asked to create a sign-in name and password to access certain portions of JRI-Poland’s website. You are responsible for maintaining the confidentiality of your sign-in name and password. You are responsible for all activities that occur using this sign-in name and password. If someone else uses your sign-in name and password in such a way as to breach the terms of these Terms of Use, you remain responsible for such actions, and JRI-Poland may suspend or terminate your account and use of JRI-Poland’s website.
If you are under the age of 18, you must obtain your parent’s permission to create a JRI-Poland account or to perform searches on JRI-Poland’s website. If you are under the age of 13, you are not permitted to have a JRI-Poland account or to perform searches on JRI-Poland’s website. JRI-Poland’s website is not intended for children under the age of 13 and we do not knowingly collect or use information from children under the age of 13. If JRI-Poland learns that it has inadvertently gathered personal information from children under such age, it will take reasonable measures to promptly erase such personal information from its records.
Your privacy is very important to us. Our Privacy Policy sets forth important information on how we collect, process, use, and share your data; that Policy is incorporated by reference herein. By using JRI-Poland’s website and submitting your personal information to JRI-Poland, you consent to the processing in the United States any personal data that you submit in accordance with JRI-Poland’s Privacy Policy.
JRI-Poland reserves the right to modify these Terms of Service. JRI-Poland will provide you with advance notice of any material modifications to these Terms of Service.
